What your purchase includes.
After payment is confirmed, we grant the original purchaser a personal, non-exclusive license to install and use the purchased major version of Cloth & Colour on their own Mac and Windows computers. All core design tools are included. There is no subscription, fixed device cap or per-device activation charge for those computers.
The license does not expire when a later major version is released. A later major upgrade may be offered separately; buying it is optional. The supported operating systems and download requirements are listed on the downloads page and recorded with your purchase agreement. This purchase does not promise future operating-system compatibility.
Your own computers.
Your license is personal to the original purchaser. You may install and move it among your own Mac and Windows computers. You may not share, sell or transfer the license to another person, except where applicable law requires otherwise. Keep the license file private. Do not share it as a public download, sell copies of the software, or use one purchaser’s license as a license for unrelated purchasers.
The app checks the downloaded license locally. Core editing, project files, printing and exports work offline. Community sign-in is separate from the paid app license.
Your creative work.
Your original quilt designs, blocks and fabric photographs remain yours. Using Cloth & Colour does not transfer ownership of that work to us. You decide whether to publish or sell your own original patterns, subject to rights in any source material you use. You are responsible for having permission to use material you import or share.
You may make and sell finished physical quilts using the original designs included with your Cloth & Colour purchase. This permission does not let you resell our included pattern files or original artwork as a pattern collection. It does not give us exclusive rights in traditional quilt-block ideas, or change another Community creator’s permissions.
Included software components retain their own license terms. Their notices are available in the desktop app through License & ownership → Credits & open-source licenses.
Updates and support.
All updates within the purchased major version are included. Individual email support is included for 12 months after purchase. Future operating-system compatibility and a permanently hosted recovery or Community service are not promised. Keep independent copies of your projects and license.
Community is an online service and needs an account and internet connection. Its availability does not control access to your offline project files or purchased major version. See support and refunds for purchase help.
Refunds and ending the license.
The refund process is in Support and refunds. If we refund your app purchase in full, your permission to use that app license ends. Stop using the refunded license and remove the app copies licensed by it; you may keep your own quilts, blocks, fabric photos, exported patterns and backups. Offline licensing does not let us remotely erase your files or automatically remove an installed app.
We may end an app license for a material breach of these terms after giving notice and a reasonable opportunity to correct it, except where fraud, unlawful distribution or an urgent security issue requires immediate action. Any action must respect applicable law. Closing your Community account or declining an optional major upgrade does not end a valid paid offline license.
What to expect from the software.
We will provide the purchased software substantially as described at purchase and use reasonable care in providing the services we offer. We do not promise that software will be error-free, that online services will always be available, or that every imported shape or construction method can produce an automatic making plan.
Fabric quantities and making plans depend on your measurements and choices. Check units, usable fabric width, seam allowances, directional prints, shrinkage and construction warnings. Calibrate actual-size printing and make a test block before cutting a full quilt. Keep independent copies of your work. These practical checks do not remove any legal remedy for a defect or a failure to meet an express commitment.
Limits that respect your consumer rights.
Only to the extent applicable law permits, we are not responsible for indirect or consequential loss, lost profits, or losses caused by using an unchecked plan, inadequate backups or use outside the supported requirements. Our total liability arising from a particular app purchase is limited to the amount paid for that app license.
These limits do not apply to fraud, deliberate wrongdoing, gross negligence, death or personal injury for which liability cannot lawfully be limited, or any other liability or remedy that applicable law does not allow us to exclude or limit. Nothing here reduces a mandatory warranty, refund, cancellation, privacy or other consumer right.
The terms saved with your purchase.
The version of the purchase terms recorded with your order governs that purchase. A later website edit does not silently replace your saved agreement or remove the granted right to use your purchased major version. New purchases and optional upgrades can have new terms, shown before you buy. Material changes requiring your consent under applicable law will not take effect without that consent.
We may update the privacy notice to explain actual changes in information handling. Where a change requires new consent, we will seek it. Community operating rules may change prospectively, subject to applicable law and the sharing permissions already granted.
Your legal rights and resolving a problem.
These terms do not exclude rights or remedies that applicable consumer law does not allow us to exclude. The stated refund window does not replace those rights. Contact us about a problem before sending private project or payment information.
The laws of Ontario and applicable Canadian federal law govern these terms, subject to any mandatory protections and rights to bring a claim where you live. These terms do not require private arbitration or waive a right to join a class proceeding. You may contact support to try to resolve a concern; doing so is not a condition that takes away a statutory remedy.
